1. Validity
These General Terms and Conditions of WALTER Werkzeuge Salzburg GmbH apply to the ordering of goods from the product range offered in our online shop. Upon conclusion of the contract, these terms and conditions apply to all mutual claims between the customer and WALTER Werkzeuge Salzburg GmbH. Any deviating terms and conditions of the buyer do not become part of the contract and are invalid.
2. Conclusion of contract
By clicking the "Order" button, you submit a binding offer to purchase the goods in your shopping cart and accept the General Terms and Conditions. The order summary that is subsequently sent automatically documents that the order has been received, but does not constitute acceptance of the offer. A contract is only concluded upon dispatch of the goods.
3. Delivery
3.1. Delivery of the goods is at the customer's expense and risk. The shipping costs displayed in the online shop for the goods and upon payment are to be borne by the customer.
3.2. If the ordered goods are available, the statutory delivery periods apply, unless otherwise agreed. Specified delivery periods are non-binding unless expressly declared as binding. For deliveries against advance payment, the goods will only be dispatched after receipt of payment.
3.3. The customer must report incomplete deliveries or damage during transport, as well as damage despite proper packaging, to the responsible post office or delivery company within 24 hours. Submission of the completed report is a prerequisite for replacement delivery.
4. Prices and payment terms
4.1. All prices on this website are in EUROS or POUNDS, including VAT or sales tax, and excluding packaging ex works. The prices listed on the website apply only to online orders.
4.2. You can pay on this website using the following payment methods: PayPal, credit card (Visa & Mastercard), SOFORT Überweisung**, purchase on account**, or advance payment**. Our invoices are payable within 10 days of the invoice date. The goods will be shipped after full payment has been received.

5. Retention of title
WALTER Werkzeuge Salzburg GmbH retains title to all goods delivered to a customer until final and complete payment for the delivered goods. If WALTER Werkzeuge Salzburg GmbH replaces a product under the warranty, it is agreed that the replaced product becomes the unrestricted property of WALTER Werkzeuge Salzburg GmbH.
6. Warranty and Liability
WALTER Werkzeuge Salzburg GmbH guarantees that the products are free from defects at the time of delivery which would negate or reduce their value or suitability for normal use, and that the products have the guaranteed properties at the time of delivery.
6.1. Notice of any apparent defects must be given in writing within 8 days at the latest, enclosing the delivery note and/or invoice.
6.2. If our goods have defects for which we are liable, we are only obligated to repair or replace, free of charge at our discretion, those parts that have demonstrably become unusable as a result of a circumstance that occurred before the transfer of risk. The defective goods must be returned to us in their original condition for inspection.
6.3 We may refuse to repair or replace the goods until the Buyer has fulfilled all of his obligations not related to the defective part of the goods.
6.4. In the case of justified complaints, we reserve the right to issue a credit note for the value of the goods instead of repairing them.
6.5. Further claims by the buyer, in particular claims for rescission, reduction or damages, are excluded.
6.6. If a defect is reported to us and we accept the complaint, the shipment to us must be made carriage paid. Returned goods not prepaid will not be accepted.
6.7. The warranty period is 24 months from delivery, subject to presentation of the original purchase invoice. Our products are not intended for commercial use. The warranty expires upon commercial use.
7. Right of withdrawal (right of cancellation)
Right of withdrawal
7.1. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods (or, if you ordered multiple goods that were delivered separately, the last goods).
7.2. To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may also use the attached model withdrawal form , although this is not mandatory.
7.3 To comply with the cancellation period, it is sufficient for you to send the notification of the exercise of the right of cancellation to the following address before the cancellation period has expired:

Consequences of revocation
7.4. If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.
7.5 In the case of sales contracts in which we have not expressly offered you the option of collecting the goods yourself in the event of cancellation, we may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.
7.6 You shall bear the direct costs of returning the goods.
7.7. You only have to pay for any loss of value of the goods if this loss of value is due to handling which is not necessary to check the quality, properties and functioning of the goods.
Carrying out the return
7.8. Please return the goods complete, including all accessories and in their original packaging.

9. Place of performance and jurisdiction
The legal relationship between the buyer and WALTER Werkzeuge Salzburg GmbH is governed exclusively by Austrian law. The place of performance for delivery and payment is 5081 Anif, Austria. The place of jurisdiction for all disputes arising from or relating to this contract is the City of Salzburg.
